Equal Pay

Members will be aware that we initiated a campaign to reverse the decision of the Department of Finance and Personnel (DFP) to exclude most pensioners in the AA, AO and EO2 grades who retired before 1 August 2008 from benefiting from the Equal Pay Settlement made between the Department and Trade Union Side.

Unbeknownst to us in July 2012 NIPSA served writs on behalf of some 200 former Trade Union Members and following the landmark judgement in the Supreme Court on 24 October 2012, known as Abdulla v Birmingham City Council, (which ruled that cases which were out of time because of the six-months rule in an Industrial Tribunal could still be taken in the Civil Courts where the time limit would be six years), NIPSA served a further 200 writs in December 2012.

In January 2014 DFP came to a settlement with Trade Union Side where approximately 400 former Trade Union Members who retired or left before 1st August 2008 will now receive back pay and adjustment to their Pension according to a formula.

For those where Trade Union Side served writs on 2nd July 2012; they will receive adjustments for time served between 2nd July 2006 and 31st July 2008 and for those where Trade Union Side served writs on 7th December 2012; they will receive adjustments for time served between 7th December 2006 and 31st July 2008.

DFP have identified 700(approx.) other qualifying personnel and in their case they will receive adjustments for time served between 1st January 2008 and 31st July 2008.

Following a meeting of the Chairman and Hon.Sec. with Mark Bailey from DFP the Chairman has written to the Minister outlining how unhappy we were with the whole process of dealing with those retirees denied compensation because they had retired before some arbitrary date.
